1. About AlpacaCloud
AlpacaCloud is a web-based herd management service for alpaca owners, breeders and related users. It provides tools for recording and managing information such as animals, pedigrees, breeding, births, health records, body scores, shearing, ownership, sales, documents, photographs, tasks, calendars and reports.
In these terms, “AlpacaCloud”, “we”, “us” and “our” mean the operator of the AlpacaCloud service. “You” means the person or organisation creating or using an AlpacaCloud account.
2. Your account
You must provide accurate information when registering and keep your account information reasonably up to date. You are responsible for keeping login credentials secure and for activity carried out through accounts you control. Please notify us promptly if you believe an account has been accessed without permission.
The first user registering a breeder account may be given owner or administrator permissions and is responsible for managing any additional users invited to that account.
3. Plans, subscriptions and payment
AlpacaCloud may offer free and paid plans with different limits and features. Current plan information and prices are shown on the website or within the service. A new account may begin on the Free plan without a payment card.
Where you choose a paid plan, charges and the billing frequency will be shown before you subscribe. Payments may be processed by a third-party payment provider such as Stripe. We do not require you to provide full payment-card details directly to AlpacaCloud where those details are collected by the payment provider.
You can manage an eligible paid subscription through the billing facilities provided within AlpacaCloud. Any applicable cancellation date, plan change or future charge should be shown during the relevant billing process. Nothing in these terms removes any cancellation, refund or other rights that you have under applicable law.
4. Plan limits and changes
Plans may include limits relating to animals, users, storage or available features. If you reach a plan limit, you may need to remove data where appropriate or change plan before adding further records. We may update plan features or pricing from time to time. Where a change affects an existing paid subscription, we will provide notice where required and will not remove rights provided by law.
5. Your data and records
You retain ownership of the information, records, documents, photographs and other content that you or your authorised users upload to AlpacaCloud (“Your Content”). You give us permission to host, copy, process, back up and display Your Content only as reasonably necessary to provide, secure, maintain and improve the service and to comply with law.
You are responsible for ensuring that you have the right to enter, upload or share Your Content and that doing so does not infringe another person’s rights or breach applicable law.
6. Animal and health records
AlpacaCloud is a record-management tool. Information, reminders, reports or calculations produced by the service are not veterinary, medical, legal, tax or other professional advice. You remain responsible for animal welfare decisions and for obtaining appropriate professional advice where needed.
7. Acceptable use
You must not use AlpacaCloud unlawfully, attempt to gain unauthorised access to another account or system, interfere with the operation or security of the service, introduce malicious code, use the service to distribute unlawful or infringing material, or deliberately misuse features in a way that harms AlpacaCloud or other users.
8. Availability, maintenance and backups
We aim to keep AlpacaCloud available and reliable, but uninterrupted or error-free operation cannot be guaranteed. We may carry out maintenance, security work and updates, and unexpected outages may occur. We take reasonable measures to protect and maintain the service, but you should retain copies of information that is especially important to your business or herd management where appropriate.
9. Intellectual property
AlpacaCloud, including its software, design, branding and service content (excluding Your Content), is owned by us or our licensors and is protected by applicable intellectual-property laws. Your subscription or account gives you a limited right to use the service; it does not transfer ownership of the software or branding to you.
10. Suspension and termination
You may stop using AlpacaCloud and may request closure of your account, subject to any active subscription arrangements and legal retention requirements. We may suspend or restrict access where reasonably necessary for security, non-payment, serious misuse, breach of these terms or legal compliance. Where appropriate, we will try to give reasonable notice and an opportunity to resolve the issue.
11. Liability
Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability that cannot legally be excluded under applicable consumer law. Subject to those rights, AlpacaCloud is provided as a herd-management and record-keeping service and we are not responsible for decisions made solely in reliance on user-entered records, reports or reminders where the underlying information is inaccurate, incomplete or out of date.
12. Third-party services
AlpacaCloud may use or link to third-party services, including payment, email, hosting or other infrastructure providers. Their own terms and privacy practices may apply when you interact directly with those services.
13. Changes to these terms
We may update these terms to reflect changes to AlpacaCloud, the law, security requirements or our business. Material changes will be communicated in a reasonable manner where required. The latest version will be available on this page with its revision date.
14. Governing law
These terms are governed by the laws of England and Wales. If you are a consumer, you also retain any mandatory rights and jurisdiction protections that apply to you where you live.
